If you have minor children, you can set up a Trust for them in your Will. This ensures they are financially cared for and have access to funds for their maintenance with minimal hassle. Without a Will, any funds due to minor beneficiaries must be paid into the Guardian’s Fund at the Master of the High Court. These funds can only be accessed by their legal guardian, who must complete forms and provide supporting documents for each request – something that can easily be avoided by appointing a Trustee in your Will. The Trustee can then make the necessary arrangements for maintenance payments with far less paperwork.

Your Will also includes the appointment of your Executor – the person responsible for administering your estate. When a person passes away, their assets are frozen and cannot be dealt with until an Executor is officially appointed by the Master of the High Court. Having a Will that names your Executor helps to minimise this delay.
